법의 무지는 용서되지 않는다 "Ignorance of the law is no excuse"

1.법의 무지는 용서받지 못한다는 법언이 주로 작동하는 영역은 일종의 위법성의 착오(금지착오, 법률의 착오, 형법 제16조 자기의 행위가 법령에 의하여 죄가 되지 아니하는 것으로 오인한 행위는 그 오인에 정당한 이유가 있는 때에 한하여 벌하지 아니한다.)에 대한 부분. 

예를 들어 어떤 사람이 남의 물건을 보고 탐이 나서 슬쩍 해서 자기 가방에 넣고 집에 왔다고 할 때, 이를 우리 형법상 절도죄로 처벌하게 되는데, 이 사람이  '나는 형법에 절도를 처벌하는 규정이 있는지 몰랐다.'라고 항변할 수 없습니다. 이를 우리 형법학에서는 위법성의 착오에 정당한 이유가 없기 때문이라고 보는데, 이러한 상황을 설명하면서 약간은 시적이며 약간은 비유적으로 '법의 무지는 용서받지 못한다'라고 표현합니다. 

2. "Ignorance of the law is no excuse" is a common phrase in the law. It means that if an individual breaks a law, they cannot defend themselves by claiming that they did not know that there was a law to be broken, or that they were breaking it. 

This topic is often tied in with "mens rea(범의, 고의)." Mens rea is a concept the law uses to describe a mental element(주관적 구성요건 요소) of a crime. Often, a crime is defined as requiring that the individual have both committed the act of the crime (the "actus reus") and intended to commit the crime ("mens rea.") There was a time when criminals would claim that they did not intend to commit the crime, because they did not know that the act which they committed was a crime. 

This is why the law developed the concept that "ignorance of the law is no excuse." It creates an irrebutable presumption that every person knows what the law is, and that no one can claim that they did not have the mens rea because they did not know what the law is.
